Acceptable Use and User Conduct Policy
1. General Terms
By registering for, accessing, or using the Services provided by Atlas Cloud AI LLC ("the Company"), you ("the User") acknowledge and agree to comply with this Acceptable Use and User Conduct Policy ("the Policy").
Use of the Services constitutes your full acceptance of and agreement to be bound by this Policy and all applicable laws and regulations.
For clarity, "Users" under this Policy include individual consumers, business entities, and any third parties who access or utilize the Services through a reseller, distributor, or white-label arrangement.
This Policy applies to all users, including any affiliates, subsidiaries, or authorized resellers of the Company.
2. Prohibited Uses
Users are strictly prohibited from using the Company's Services, APIs, or any content generated therefrom for any unlawful, unethical, or harmful purpose, including but not limited to:
- Sexually Explicit or Adult Content – Creating, distributing, or promoting pornographic, obscene, or sexually suggestive material, including any AI-generated or deepfake sexual content.
- Violence or Harm – Generating or distributing content involving graphic violence, self-harm, suicide, torture, or cruelty to humans or animals.
- Hate Speech or Discrimination – Promoting hate, harassment, discrimination, or defamation based on race, religion, nationality, ethnicity, gender, sexual orientation, disability, or any other protected characteristic.
- Political or Disinformation Campaigns – Engaging in or supporting coordinated political manipulation, propaganda, election interference, or the creation and dissemination of false or misleading information.
- Fraud, Deception, or Misuse – Conducting scams, phishing, impersonation, identity theft, or any other form of deceptive or fraudulent activity.
- Malware or Cyberattacks – Developing, distributing, or assisting in the creation of malicious code, viruses, or hacking tools.
- Invasion of Privacy – Collecting, storing, or disclosing personal information without consent.
- Medical, Financial, or Legal Misrepresentation – Generating false or misleading professional advice in regulated domains such as healthcare, finance, or law.
- Violation of Law – Using the Services in any manner that violates applicable laws, sanctions, export controls, or regulatory restrictions.
- Cultural and Ethical Respect – Generating or distributing content that disrespects local customs, cultural heritage, moral values, or religious beliefs in any jurisdiction where the content may be accessed or viewed.
3. Reseller and Enterprise Use
Resellers, distributors, or enterprise customers ("Partners") who access, integrate, or redistribute the Services are subject to the following obligations:
- Partners shall ensure that all downstream or end users to whom the Services are resold, sublicensed, or otherwise made available are bound by terms no less restrictive than those set forth in this Policy.
- Partners remain fully responsible and liable for any acts or omissions of their end users that would constitute a violation of this Policy if performed directly by the Partner.
- The Company reserves the right to request copies of a Partner's downstream acceptable-use terms and to require modifications where necessary to maintain consistency with this Policy.
- The Company may suspend or terminate a Partner's access, resale, or distribution rights if any of its downstream users materially breach this Policy.
- This Policy applies equally to any sublicensed, white-labeled, or redistributed access to the Services provided through authorized Partners.
4. Cultural Sensitivity and Ethical Use
Users are required to respect the diversity of global cultural norms and ethical standards.
The Company reserves the right to restrict or remove access to any content or activity that, in its sole discretion, violates principles of cultural respect, moral decency, or public order—even if such content may not explicitly breach a specific law.
The Company encourages creative freedom within the bounds of cultural and ethical respect.
5. Security and Integrity
Users shall not attempt to probe, scan, or test the vulnerability of the Services, nor interfere with or disrupt the security, performance, or functionality of the system.
Users must not attempt to gain unauthorized access to any part of the platform, its servers, or connected networks.
Monitoring and review of system usage may include automated detection mechanisms and manual audits to ensure compliance with this Policy.
6. AI Output and Responsibility Disclaimer
Users understand and acknowledge that outputs generated through the Services, including AI-generated content, may not always be accurate, complete, reliable, or suitable for their intended purpose.
The Company makes no representations or warranties regarding the factual accuracy or appropriateness of generated content.
Users are solely responsible for evaluating and verifying all outputs before relying on them for any purpose, including professional, commercial, or public use.
The Company disclaims any liability for damages or losses resulting from reliance on such outputs.
7. Compliance and Enforcement
The Company reserves the right to monitor and review usage for compliance with this Policy.
Any violation may result in immediate suspension or termination of the User's account, access privileges, or any ongoing service, without prior notice.
The Company also reserves the right to report suspected unlawful activity to law-enforcement or regulatory authorities when deemed appropriate.
8. Disclaimer and Limitation of Liability
The Company provides its Services "as is" and assumes no liability whatsoever for any content created, transmitted, or distributed by Users.
Users are solely responsible for ensuring their own compliance with all applicable laws and ethical obligations when using the Services.
To the maximum extent permitted by law, the Company expressly disclaims all warranties, express or implied, and shall not be liable for any direct, indirect, incidental, or consequential damages arising from or related to User-generated content, reliance on AI outputs, or misuse of the Services.
9. Termination
The Company reserves the right, at its sole discretion, to suspend or terminate a User's account and access to the Services at any time and without prior notice if it determines that the User has violated this Policy, applicable law, or poses a risk to the integrity or reputation of the Company.
Users may contact the Company's support team for limited review of termination decisions, at the Company's discretion.
10. Governing Law and Jurisdiction
This Policy shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict-of-law principles.
Any dispute arising from or relating to this Policy shall be subject to the exclusive jurisdiction of the federal and state courts located in Delaware, provided that the Company may, at its discretion, bring actions in other jurisdictions where harm occurs.
11. Indemnification
The User agrees to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
- the User's violation of this Policy or any applicable law;
- the User's misuse or unauthorized use of the Services;
- any content generated, uploaded, or distributed by the User through the Services;
- any third-party intellectual-property claims; or
- any dispute or claim between the User and a third party arising from the User's conduct.
In the case of Partners or Resellers, such indemnification shall also extend to any claims arising from or related to end users' conduct or breach of this Policy.
This obligation shall survive the termination or expiration of the User's account and shall remain in full force and effect to the maximum extent permitted by law.
12. Acceptance
By registering for an account, accessing the platform, or using the Services in any manner, you acknowledge that you have read, understood, and agreed to abide by this Acceptable Use and User Conduct Policy in its entirety.
